When you file bankruptcy you discharge your liability on unsecured debts (with some exclusions, for instance, taxes or student loans) and secured debts. Due to the lien on secured assets, you need to keep paying on the debt to keep the property, but your liability on the debt is discharged through your case. As long as you have not signed a reaffirmation agreement in the bankruptcy, you can surrender your filed secured assets back to the lender during or after bankruptcy, and not be liable for any balance owed on the loan, due to the discharge. This is the same regarding involuntary repossessions as well, if after filing you fall behind on payments and have a repossession, you will not be liable for the balance, due to your bankruptcy discharge. 

The prospect of having to go to court can be intimidating and often deters people from filing for bankruptcy, despite the fact that it can bring them tremendous relief from their creditors. Just the thought of having to appear in front of a judge to explain one’s situation and request relief from bankruptcy court from one’s personal debts can seem like a daunting endeavor. The good news is that this scenario is extremely rare, and nowadays, a person can file for bankruptcy, and receive a discharge of their debts, without even having to physically set foot in a courtroom!

Filing bankruptcy is a court action. The bankruptcy filer will file a petition, and receive a case number, meet with a trustee, and there is a possibility of additional court actions, motions, and ultimately the case will be discharged and closed. But, as a bankruptcy filer you have some responsibilities to the court. Bankruptcy exists for the protection of the debtor and to provide the debtor with relief from their creditors, but there is also an onus on the debtor when filing.
