Almost every client wants to know where their case will be filed and whether the county they live in is the location for filing. The county you live in does determine where your case is filed, but your case will not be filed in your local county courthouse.
Bankruptcy is federal law, therefore your case will be filed in one of the four federal court locations in Minnesota. These are St. Paul, Minneapolis, Duluth and Fergus Falls. Each county in Minnesota falls into one of these four court locations. For example, if you live in Hennepin County your filing location is Minneapolis. But if you live in Stearns County your filing location is Fergus Falls. The Minnesota Bankruptcy website lists each location and the counties within. Your case is not filed in State court, therefore your case will not be filed in your local county courthouse.
Although attending hearings (besides your 341 hearing) is not that common in chapter 13 or chapter 7 cases, if you do need to attend a hearing, it will be at the Federal Courthouse for St. Paul, Minneapolis, Duluth or Fergus Falls. The 341 hearings are all being held virtually currently, by Zoom or telephone call.
