What is the Bankruptcy Petition?

Written by Amanda Scharber | February 6, 2026 at 11:30 AM

A bankruptcy petition is the formal legal document that initiates a bankruptcy case in federal bankruptcy court. By filing a petition, an individual or business formally requests relief under the U.S. Bankruptcy Code due to an inability to repay outstanding debts.

Filing a bankruptcy petition immediately triggers the automatic stay, a powerful legal protection that generally halts most collection activity. Once the stay is in place, creditors must stop collection calls, lawsuits, wage garnishments, and foreclosure actions while the case is pending. This protection provides debtors with critical breathing room as the court reviews their financial situation.

The petition itself is a series of required disclosures commonly referred to as bankruptcy “schedules.” These documents provide a comprehensive overview of the debtor’s finances, including assets, liabilities, income, expenses, and recent financial transactions. Debtors disclose this information under penalty of perjury, which is reviewed by a bankruptcy trustee and the court for accuracy and completeness.

The type of bankruptcy petition filed depends on the debtor’s circumstances and goals. Chapter 7 are for individuals seeking to discharge unsecured debts, while Chapter 13 bankruptcy allows eligible debtors to repay debts through a structured three- to five-year plan often use chapter 7 bankruptcy. Businesses or individuals with complex financial situations to reorganize debts while continuing operations typically use chapter 11 bankruptcy.

Filing a bankruptcy petition carries significant legal and financial consequences; consulting with an experienced bankruptcy attorney is critical. Proper guidance ensures compliance with court requirements and helps debtors pursue the most effective path toward financial stability and relief.
