What Happens After Your 341 Bankruptcy Hearing in Minneapolis, Minnesota

shutterstock_1890232762A 341 hearing is typically the only hearing you attend in your bankruptcy case. It is about a month after filing and will take about 5-10 minutes, depending on your case. The trustee of your case conducts the hearing and will go through yes or no questions with you to verify your case information. 

After the 341 hearing is over, if you are in a Chapter 7 case you will be waiting on your discharge date, which is about 90 days from the date of case filing. You may also have additional follow-up from the trustee in your case to cooperate with. For example, if you have non-exempt assets or avoidable transfers the trustee will follow up with you and your attorney. 

After the 341 hearing is over, if you are in a Chapter 13 case, you will have a confirmation hearing. This is about a month/month and a half after the 341 hearing. This is where the Judge will confirm your case and plan payments. In most cases, you will not have to attend this, usually they go by default without appearances. After the 341 hearing, you will continue to make your monthly plan payments. If something has changed where you are making substantially more money or cannot afford your payments, reach out to your attorney to discuss your plan going forward.
