In a chapter 7 bankruptcy, typically, the only hearing you will attend is the 341 hearing. This happens about 4-6 weeks after your case is filed.
To prepare for your hearing the trustee will ask for a few pieces of documentation:
- Most recent paystub to the date of the hearing. This is to determine what your earned but unpaid wages are and to verify income. Whenever your case is filed, most people will have wages that they have earned but haven’t been paid yet. The trustee will also verify income to make sure you qualify for a chapter 7.
- Bank statements covering the date of filing. The trustee will ask for bank statements to verify how much was in your account on the date you filed. They will also look at your transactions to see what was going on in the weeks prior to filing.
- Miscellaneous account statements. The trustee will also want to see statements for stock, retirement accounts, HSA/FSA, etc. for the date of filing. This is so they can verify how much was in your account.
- Any divorce decrees in the last 8 years. Your trustee will review the divorce decree to check what you received in the divorce and to see if you are still going to receive anything.
- Proof of identity. Your trustee will review your identity by reviewing both driver’s license and social security card. If you do not have your social security card, you can use a W-2, 1099, or a government produced document.
- Tax return for the most recent tax year filed. The trustee will verify income and refund amounts.
- Property tax statement. The trustee will verify what the county says your home is worth.
The trustee may request other documents as well, but the above 7 documents are always requested.
