QUIET MUSINGS OF A MINNESOTA BANKRUPTCY ATTORNEY

minnesota-bankruptcy-attorneys-kain-scott.jpgThe world is noisy isn’t it? I think it is. It seems like so much of life is fleeting and superficial. I am not trying to drowned you in despair- at all. Heck, I think the quiet moments in life, those moments when you lean back and reflect on life’s events are the real crown jewels. At 47 years of age, I can tell you that the one thing I have learned about life is how humbling it really all is.

We humans with our needs to be secure, stable, and predictable are foiled with a life that is often insecure, unstable, and unpredictable. So why not embrace life’s unpredictability and go on an adventure? Have you ever found that when you learn to let go you advance farther than if you hung on for dear life? You know, you want a boyfriend so bad that it doesn’t happen and then when you let go and relax and let life happen, you find a boyfriend!? Okay- that was out there but you get it right?

The same can be said for solutions to our financial problems. Overwhelming debt can happen to any person in the state of Minnesota- yes, I said anyone! I have met with people who were millionaires by the time they were 30 and yet they filed a bankruptcy.

BANKRUPTCY CAN HAPPEN TO ANYONE

My Minnesota Bankruptcy Attorneys and I have met with ministers, doctors, lawyers, bill collectors, bank presidents, numerous bank tellers and loan officers etc. I don’t care if you are a credit counselor it can happen to you. Just like cancer doesn’t discriminate against who it chooses, neither does debt.

Let me tell you that from my experience, if you have been to the mountain top, and you were making a lot of money, and now you are facing overwhelming debt, the courage it takes to let go is enormous. The degree of humility you face in life is sometimes enough to shake the earth under your feet.

If a light went off above the head of every single person who has filed a bankruptcy in Minnesota, you would be shocked!

IT DOESN’T MAKE SENSE TO DELAY A NECESSARY SURGERY DOES IT?

I delayed a necessary surgery because of embarrassment. When I continued to put off the surgery, I suffered needlessly. Funny thing is when I finally went in for the surgery, not one nurse or doctor thought it was interesting in the least. Nobody thought it was a big deal, except me!

Once I had the surgery, I of course, realized, I should have done this years ago! The relief I got was instant and very gratifying. I always assume that bankruptcy is like my surgery I was embarrassed to have: You delay and delay because YOU are embarrassed and yet we deal with solving debt problems every minute of every day- it’s not embarrassing for us- it’s our job!

And yet, when people summon the courage to do it, like I did with my surgery, do you want to know what they say following the bankruptcy? Every single client says the same thing: they don’t regret filing the bankruptcy they regret waiting so damn long to file! Like me, they suffer for such a long time, and they delay, having the “discussion.” And when they have the discussion and find out that getting your life back ROCKS, they always regret waiting so long before they filed.

MOST COMMON REASONS MINNESOTANS FILE BANKRUPTCY

The reasons our Minnesota Bankruptcy Attorneys see clients can typically be categorized in 1-5 reasons. Some guests have all 5 reasons, some have 1. Everyone is different. Everyone is different because all of our lives are unique to us!

1) BUSINESS FAILURE:

Do you think anyone starts a business dreaming it will be a stinking mess, with overwhelming debt, and oh yeah, you wont pay yourself either but you work 80 hours a week and end up filing bankruptcy in the end? Of course not! To those of you who take the risk, a tip of the cap to you! When it doesn’t work, bankruptcy is there to help you get back on your feet. It is one of the reasons, bankruptcy laws exist!

2) INCOME DROP:

This can obviously take many forms but imagine you were get 20k a year in overtime for the last 10 years and one day- you go to work and the boss says, sorry folks the overtime is gone forever. Do you think that will hurt your finances? Uh- it would mine!

Or, what if 6 months later, the boss says, we are selling the plant and it’s moving to Mexico. Do you think a total loss in income is going to hurt your finances? Oh sure, you will get unemployment and earn maybe 50% of what you were earning for a while but you get my point. Income drop could be you are now divorced and you lost your spouse’s income. Whatever the reason is for the loss in income, it hurts bad.

3) DIVORCE OR RELATIONSHIP BREAKUP:

Have you ever been in a place where you were so emotionally wound up you frankly didn’t give a damn about much of anything else? I think we all have been here. When relationships end, we frankly are so emotionally scarred we go to the special place where we don’t give a shit about much of anything.

That is when debts spike out of control. Lawyers and survival cost of lot of money especially when your income is down with a loss of your significant other’s income.

4) MEDICAL PROBLEMS:

Have you ever said to yourself, I am not going to the doctor for this because it will cost me money? We all have. But, can you skip going to the doctor if you are holding your broken leg in your hands? Can you skip the doctor if you have cancer? Out of control medical costs are the reason for many bankruptcies. I can remember growing up in a family of 9 children and dad was a factory worker. We never had out of control medical costs. And yet, today, with smaller family sizes, the medical costs are out of control? What gives?

5) BAD FINANCIAL DECISIONS:

We have all made them! If you are living and breathing you have made bad financial decisions. We humans are like the car commercial where the tree branch falls on our car or we drive through the garage door. If you haven’t made bad financial decisions, you are not alive, you are dead.

CONCLUSION
