Dealing with relentless calls, text, emails and letters from creditors can be overwhelming while you are trying to meet your financial obligations. Bankruptcy gives you room to breathe. When you file for bankruptcy the automatic stay goes into effect immediately. The automatic stay requires creditors to stop their collection efforts. You may be wondering who long it will take for creditors to stop contacting you? 

Even though the automatic stay goes into effect immediately, you may still receive calls, letters, and emails after filing for bankruptcy. It takes time for creditors to process the bankruptcy court’s notice of your filing. It can take up to one month for your creditors to process the notice that you have filed. Once your creditors have been informed of your filing the calls should stop. If they continue to contact you, they are in violation of the automatic stay. 

You may be wondering what to do if creditors are still contacting you after filing. If you have correctly listed the creditor in your bankruptcy case, they will receive notice through the mail. However, sometimes things get lost. If creditors are still contacting you, you may choose to inform them that you have filed or refer them to your attorney. If you are still being contacted one month after filing, let your attorney know and they will send notice to your creditor.
