If You Do These 3 Things, Don't FIle Bankruptcy

I want to make sure you understand I think bankruptcy is a wonderful tool that can be used to get your life back. I have personally witnessed thousands of Minnesotans get their lives back over many years and I can attest to you, they all were very thankful that bankruptcy exists to allow them to move on from a nightmare in the form of overwhelming debt.

But, there are people and situations that should not file bankruptcy, ever. For some reason, unknown to me, some people think bankruptcy lawyers exist to help perpetuate crimes. This is not true. No bankruptcy lawyer will risk losing their law license to perpetuate crimes.

First, if you intend to file bankruptcy but not disclose all you assets, debts, and be candid about your financial situation with the bankruptcy trustee, you should not file. Bankruptcy is not a game of hide the ball. You are seeking relief from your debts and you are required to be fully transparent about your financial situation. For those people who refuse to be transparent about their financial situation, don’t file bankruptcy.

Second, if you have non-exempt assets, and refuse to cooperate with the Chapter 7 trustee in the administration of the estate, don’t file bankruptcy. It should be no surprise to you that when you file Chapter 7 Bankruptcy you have non-exempt assets. Refusing to cooperate with the trustee in the administration of the estate is a good reason not to file a bankruptcy to begin with.

Third, if you insist on trying to navigate the bankruptcy code yourself, by representing yourself in a bankruptcy case that is a great reason not to file bankruptcy. We have witnessed the carnage that stems from clients representing themselves. It is not pretty.
