After the consultation, we set up a follow-up appointment called the review and sign, where we put together your petition in its entirety, and make sure all details in your case are true and correct. In preparation for this meeting, we provide you with a checklist of documents we will need to ensure the information in your petition is as accurate as possible.
From there, we file your case as soon as possible after you review the schedules for any errors or omissions, and the correspondence from your creditors stops within a few weeks! The next step is preparing for your 341 hearing, which typically takes place 30 days post-filing. There is some additional documentation required for this hearing, and we let you know exactly what the trustee in your case would need. The hearing itself is usually 3-5 minutes in duration, and is mostly yes-or-no questions. In Minnesota, this hearing primarily takes place via Zoom, so if you’re not super familiar with Zoom we are happy to help set it up in office as well!
After the hearing concludes, it is a 60 day waiting period until your discharge is entered by the courts. Once this is done, any debts that are eligible for a discharge are wiped out tax-free!
