How Often Can You File Bankruptcy in St Cloud, Minnesota?

US Bankruptcy Code – Chapter 7

The Bankruptcy Code states that you can file a Chapter 7 Bankruptcy, and receive a discharge, 8 years after you filed your previous Chapter 7 Bankruptcy case (where you received a discharge). You can file a Chapter 13 Bankruptcy, and receive a discharge, 4 years after filing a Chapter 7 Bankruptcy and receiving a discharge.

US Bankruptcy Code – Chapter 13

And in an awkward Bankruptcy Code provision, you can file a Chapter 13 Bankruptcy (and receive a discharge) in another Chapter 13 case filed 2 years after the first Chapter 13 case. The weird thing is you don’t normally receive a Chapter 13 discharge for 3-5 years after filing the case. That is why the 2 year statute to refile and get a discharge is so awkward. Anyway, it is there if you need it!
