How long should it take to file a bankruptcy?

At Kain & Scott, we pride ourselves on being able to file a bankruptcy case as quick as any other firm in the country, but the reality is that for many situations, you do not have to rush to file for bankruptcy relief. The decision of “when should you file bankruptcy” can be as important as the question “should I file for bankruptcy” in the first place. This is why it helps to go over your most-important concerns the first time you speak with an attorney to set a timeline.

It pains me when clients come in for a consultation and they have been “working with” another attorney for a month or longer to get a bankruptcy case filed. I see it all the time. People will bring in all their documents to an attorney’s office, and then it will crickets from their representation for weeks on end! Other times their attorney will give them a giant work-sheet or stack of documents to complete themselves and offer no assistance or guidance in completing them. Then it will be another request for documents, followed by another meeting, more requests, then another and so on, and meanwhile you are being harassed by creditors waiting for the relief to set in! This is NOT acceptable.

At Kain & Scott we can normally file a bankruptcy within three days after we are in receipt of the documents needed and you have completed your Review and Sign appointment. We can file a case sooner if necessary (such as to stop a foreclosure proceeding/wage garnishment/judgment), or longer if you should engage in any pre-bankruptcy planning.

I have had clients who have been waiting for 6-months or longer to get their case filed with another firm, and after they came in to meet with me, we filed their Chapter 13 bankruptcy within a week. You truly benefit from working with experienced attorneys, and more importantly, a proven process that Minnesotans have chosen more than any other law firm.
