How Do I Navigate the Bankruptcy Process?

Written by James Jensen-Kowski | August 24, 2024 at 10:30 AM

When considering bankruptcy, it is very common to wonder where the path of pursuing a bankruptcy filing ultimately leads and how you will navigate the process of arriving there.  For many, bankruptcy is a new concept that lies outside of prior life experience and represents a brand new avenue through which we can address the challenges of overwhelming debt.  However, you will not walk this path alone.  Our firm has one mission, one single purpose, and that is to be there with you every step of the way as you walk through the journey of bankruptcy and leave the burdens of overwhelming debt behind you permanently.

One of the primary things that our firm will assist you with throughout the bankruptcy process will be to act as your guide and point of reference as you progress toward the ultimate goal of receiving the bankruptcy discharge.  From the beginning of the bankruptcy process, we will advise you on which type of bankruptcy will best suit your needs and provide insight into the documents necessary to complete the bankruptcy filing.  We will assemble your bankruptcy case using these documents and information obtained by speaking with you directly during our review and sign process, and through this, we will prepare your case to be filed.

From there, your attorney will walk you through the steps to take pre-filing and consult with you about the structure your bankruptcy will take.  After the bankruptcy is filed, various team members will engage with you to ensure that the bankruptcy runs as smoothly and seamlessly as possible.  This will include assisting you in providing necessary documents to the court, verifying that your questions are answered, and ensuring all applicable deadlines are met.  When the time comes to speak with the Trustee (the federal official overseeing your bankruptcy) during your First Meeting of Creditors (also called a 341 hearing), an attorney from our firm will be right there with you for the entire time you speak with them.

Finally, when the discharge takes place and the debts being addressed through the bankruptcy are resolved, our staff will assist you with the process of determining the next steps forward heading out of bankruptcy through our 90-day credit repair program.
