Duties involved with filing bankruptcy

What exactly does filing a bankruptcy involve? Well that largely depends on if you choose to have an experienced bankruptcy lawyer do the work for you or not. What the law requires is stated in 11 U.S.C. § 521. (See https://kainscott.com/us-bankruptcy-code/chapter-v/ss-ii/code-521). These are strict requirements which can result in you being denied a discharge in your bankruptcy, and your debt not being eliminated if you do not comply with the requirements.

This is mainly why I would never recommend that someone file a bankruptcy without a lawyer. Filling out the bankruptcy schedules properly presents its own challenges and strategic considerations, but if you file a bankruptcy, you have many ongoing affirmative duties you must comply with. Either the bankruptcy trustee, your creditors, or a bankruptcy judge can bring motions or order you to perform tasks (including to sell your home or other assets which are not properly disclosed/exempted). Additionally, you have duties to disclose certain windfalls of cash or income raises for certain periods of time after filing.
