What Can You Do About A Rude Creditor in Bankruptcy

creditor_harassmentCreditors and collection agencies can be a mixed bag. You never know if you will receive someone understanding and nice or someone who is less than understanding about your situation. 

What happens when you get a not-so-nice creditor? Your options can depend on where you are with your bankruptcy filing. 

Pre-Filing, No Attorney Hired but Bankruptcy is on Your Mind:
Ignore the calls! You shouldn’t have to deal with someone who is rude or mean to you. Otherwise, you can answer the call.  

Pre-Filing, Retained Bankruptcy Attorney:
You can still ignore the calls! You can also answer and tell the creditor that you have retained an attorney and all communication should go through the attorney. Most creditors and collection agencies will stop calling you, and instead will call your attorney directly. 

Post-Filing:
After you bankruptcy case is filed, the automatic stay is in place. The automatic stay, stops most (*there are a few exceptions) collection efforts. This means that the unsecured creditor calls should stop though. What should you do if you receive a few calls here and there? You can ignore them, you can answer and tell them you have filed bankruptcy, or you can answer and ask them to call your attorney. If it has been awhile since your case was filed and you are still receiving calls, speak with your attorney about possible options.  

Bankruptcy Discharge is Ordered:
At this point, your dischargeable debt has been discharged. If you are still receiving collection efforts from creditors listed in your case, reach out to your attorney. Your attorney should be able to help with next steps.
